Subdivisions

Our team has over 40 years of knowledge and experience in the area of subdivisions. We deal with small to medium sized subdivisions on a daily basis and we also act for a number of developers who are undertaking large and complicated subdivisions. We are up to date with current legal requirements and we are equipped to deal with the many challenges developers encounter throughout the subdivision process.

Our services include:

  • Initial discussions with developers and clients to provide them with a guide to the process and outline what is needed
  • Discussions with surveyors and engineers regarding the subdivision
  • Co-ordinating surveyors, engineers, developers, planners and the relevant local council for resource consent
  • Drafting agreements for sale and purchase, including further terms of sale, with specific reference to the subdivision process
  • Drafting land covenants
  • Drafting easements and new title documents
  • Liaising with accountants in respect of GST and tax implications on transactions
  • Providing advice to real estate agents in respect of selling properties off the plan
  • Negotiations with lenders to secure funding for the subdivision
  • Liaising with Council and surveyors in relation to issue of section 223 certificates and section 224 certificates
  • Discussing, negotiating and resolving issues with local councils, service providers, and government agencies
  • Approving and depositing plans for subdivisions
  • Negotiating with lenders for the partial release of securities on sale
  • Liaising with LINZ (land registry) and carrying out registration of subdivision and issue of new titles
  • Attending to settlement of sales
  • Advising on compliance with the Financial Markets Conducts Act and securities issues
